After graduating from UC Berkeley Law School, Dayan served as a law clerk to Ninth Circuit Judge Betty Fletcher. He worked at Hall and Phillips, as a fellow and staff attorney, and worked on many CLIPI cases including Citizens Against Gated Enclaves.
After his time at CLIPI, Dayan became a successful attorney in the DC Metropolitan area. In 1994, he joined Bredhoff & Kaiser, representing labor organizations, benefit funds, and other nonprofit organizations. Dayan has co-authored several briefs in the US Supreme Court and has argued more than two dozen appeals. He has argued cases in nine different federal circuit courts, as well as two state supreme courts. Dayan continues to serve as a member at Bredhoff & Kaiser.
