Included as well in the press release by the FDA is the request of the agency for consumers and healthcare professionals to report any serious side effects or issues on the product quality from using ecigarettes. This request has most likely given birth to the confusion of the public regarding ecigarette positives and efficacy.
It was during this time of the press release that FDA was suing the co-founder of TVECA, Ray Story. The Washington, DC Appellate later announced its ruling that the FDA has not presented evidence that will show that ecigarettes are harmful to anyone. This decision was made regarding the interest of the public and harm that third parties could experience.
Incidentally, the agency was given a period of one year to look for and present before the court any incident wherein a consumer was harmed due to ecig use in order to support its allegation. Eventually, the FDA failed to find and present even single evidence.
